Syllabus

Course Objectives

The course aims to provide knowledge of private international law, with reference to jurisdiction, applicable law and the recognition and enforcement of decisions within the various international, European Union and national legislative sources. At the end of the course, students will be able to understand the coordination between the legal rules in order to deal with situations with transnational elements.


Course Prerequisites

Students are invited to verify the information related to their studies programme.


Teaching Methods

Teaching will take place through lectures dedicated to learning the concepts and regulatory instruments that characterise private and procedural international law, with the active participation of students. During the course, materials provided by the lecturer will be used to supplement the reference text.


Assessment Methods

The final exam will be oral and will be held with a view to ascertaining, besides the knowledge of the topics of the course, that the student has developed sufficient analytical abilities. In particular, the oral examination is aimed at assessing the level of the preparation and the analytical and argumentative skills of the student.


Contents

The course focuses on the analysis of legislative framework on conflicts of law, conflicts of jurisdiction and the circulation (recognition and enforcement) of decisions contained in the private international law acts of the European Union, international conventions and, finally, on a residual basis, in domestic legislation, in the field of company law and family law in situations characterised by transnational elements.
