Syllabus

Course Objectives

The in-depth analysis of the environmental criminal law is the main goal of the course.

The aim of the course is to offer a deep acknowledgment and understanding of some main concepts of the general part of criminal law, which are pivotal for the environmental criminal law.

In the second part a peculiar attention will be given to the interpretation and implementation of the norms and the case law concerning the eco-crimes. This will be particularly useful in providing students with tools to independently develop critical analysis skills allowing a more in depth views of court cases.

At the end the student will have acquired acknowledgement of the environmental criminal law and of the general categories, which are applied especially in this field.

Teaching Methods

Lectures in Italian.

Special attention will be payed to the direct dialogue with students, that are invited to make proposals on issues of their peculiar interest

In order to achieve the educational goals, interdisciplinary lessons, supplementary teaching activities, insights on topical practical issues will be organized through the frequency of seminars, including international webinars.

Students will be encouraged to participate actively in class and to give a written or an oral presentation on a topic set by, or negotiated with, professors.


Assessment Methods

The final exam consists of an oral interview in which the student's ability to:


- have learned a scientifically mature method for the study of the proposed topics will be assessed;


- have approached the study of the texts and the discussions in class (for those attending) in a critical manner with particular attention to the use of sources;


- know how to discuss the topics covered during the course.

Individual responsibility / nullum crimine sine culpa

Harm to others and harm to legal goods

The European legal area

Duty to protect and sphere of competence

Causation and imputation

Endangerment

Intention, negligence, precautionary principle

Punishment

Corporate crimes

Part 2:

The new environmental criminal law: principles and categories

Gradual development of the system

The typical sanctions: obligations to put into recovery and remediation, confiscation

The eco-crimes
