Syllabus

Course Objectives

Develop a critical insight and analysis abilities with regard to the European civil laws systems, with a main focus on criminal procedure, through a theoretical, historical and comparative analysis.

Course Prerequisites

Students should have passed the exam of Fundamentals of Roman Law (law students only).

Teaching Methods

Lessons with slides in power point format. The slides will be placed on the e-learning platform. Attending the course is highly recommended. Tutoring dedicated to promote learning of the matter will be provided.

Assessment Methods

Written examination at the end of the course. The written multiple-choice test will be structured in order to verify the acquisition by students of the required knowledge and skills. Students who have passed the test may, at their discretion, also request an oral interview; the interview, if conducted, will cover the entire exam syllabus and can confirm, improve, or worsen the test result.



Contents

The course is focused on the formation and development of European law, and on its Roman roots. We will especially analyze, with constant reference to the Roman experience of the late imperial age, the main problems of criminal procedure and criminal trial including the due process, the adversarial and inquisitorial models, the theory of evidence.
