Syllabus

Course Objectives

The main objective of the course is to provide the student with the skills necessary to understand the medical and scientific aspects governed by the legal system in order to be able to face future activities related to the future employment and professional opportunities.

The first specific objective is the knowledge and understanding of fundamental bio-medicolegal issues in the legal system such as life and death, criminal law, civil law, medico-legal methodology, legal and deontological rules founding the activities of the health professional.

The second specific objective is to contribute to the construction of the skills to apply knowledge and understanding in future employments and professional activities, exercising these skills with concrete cases in various areas, including pathology, toxicology, psychopathology and forensic genetics to contribute to the evaluation of procedural purposes of scientific evidence.

Special attention will be paid to the development of the ability to interact with other specialists in the legal world such as expert witnesses in the search for the solution of practical cases.


Course Prerequisites

The student must know the general principles of Public and Private Law with specific reference to Criminal Law and Civil Law (both substantive and Procedural Law).


Teaching Methods

Traditional with slides. Possibility of group discussion of themes proposed by the students.



Assessment Methods

Oral (three questions). The level of understanding of the medical and scientific aspects governed by the law will be assessed.



Contents

- Introduction to forensic medicine and biomedical-legal sciences.

- The historical evolution from Hammurabi to the present day.

- Medicine and the scientific method: deductive, inductive and abductive inferences.

- The general principles and purposes of Forensic Medicine.

- Forensic Medicine and its relationship with scientific investigations: Lacassagne and forensic ballistics, Ottolenghi and the scientific police investigations.

- The human person as a subject of rights: life, birth, legal capacity, legal abilities. Infirmity, support administrator, interdiction and incapacitation.

- Disasters: the relationship between law and medicine. Personal identification: forensic anthropology, radiological identification, odontostomatological identification. Biometry and biometrics. Age assessment.

- Fingerprints, DNA analysis and forensic genetics. • Causality: philosophy, law and biomedical-legal sciences. Causes, injuries, impairments, illness and disability.

- Civil legal medicine. Damage assessment in the field of civil liability. Biological damage, damage to working capacity. Other types of damage.

- Thanatology. Mortuary police regulations. Death diagnosis. Transplants.

- Criminal forensic medicine: from the crime scene to the court.

- Forensic pathology: tanatochronology and wounds. Traces and items pertaining to the crime.

- Forensic Toxicology. Psychoactive substances and fitness. Driving under the influence of alcohol or drugs (articles 186 and 187 of the Italian Highway Code). Fitness to work. Italian Decree 81/08 about health and safety of workers. Doping.

- Procedural aspects: expert witnesses and consultants.

- Social security and social assistance. Art. 38 of the Italian Constitution.

- Healthcare, professional liability and forensic medicine.
