Syllabus

Course Objectives

The course aims to provide students with an in-depth understanding of the fundamental institutions governing family legal relationships within the Italian legal system, with particular attention to their legislative and jurisprudential development. Building on the knowledge already acquired in the field of private law, the course seeks to develop specific competences relating to fundamental personal rights and the general principles of family law, with reference to different family models—both marital and non-marital—the personal and property relations between spouses, separation and divorce and their legal consequences, parenthood, adoption, the protection of minors and vulnerable individuals, as well as medically assisted reproduction techniques.

Another key objective is to enhance students’ ability to interpret and critically assess legal sources and major judicial decisions, through the analysis of recent case law. Students will be encouraged to engage with practical cases, thereby developing independent judgment and argumentative skills, which are essential for the practice of legal professions and for a full awareness of the jurist’s role in contemporary society.

Teaching Methods

The course is administered through lectures.


During the course, in order to deepen specific institutions of Family Law, seminars will be organized with the participation of experts in the field.


Assessment Methods

The exam takes place in oral form; there are no intermediate checks; the evaluation will be expressed in thirtieth.

The question will be structured in some questions - usually 3 - concerning the entire program in order to verify the acquisition by students of the knowledge imparted within the course. The number of questions may vary (and be greater or less than 3) due to the quality and breadth of the answers given.

Each individual response will be evaluated according to the following criteria:

- quality, completeness and relevance to demand;

- mastery of argumentation and reasoning,

- language properties and display clarity;

- ability to synthesise.


Contents

The course includes an in‑depth examination of the following topics:

- Il Diritto di famiglia: evoluzione storica e prospettive di riforma;

- La famiglia nella Costituzione e nelle norme sovranazionali;

- Il matrimonio;

- I rapporti personali fra coniugi;

- I rapporti patrimoniali fra coniugi;

- La crisi coniugale;

- Gli effetti della separazione e del divorzio nei rapporti tra coniugi;

- L'unione civile e le convivenze di fatto;

- Il rapporto genitori-figli;

- Gli effetti della crisi genitoriale rispetto ai figli;

- L'accertamento dello stato di filiazione;

- La procreazione medicalmente assistita e la maternità surrogata;

- L'adozione e l'affidamento;

- La parentela, l'obbligo alimentare e la solidarietà familiare;

- La responsabilità civile nelle relazioni familiari;

- Le novità introdotte dalla riforma Cartabia nel diritto di famiglia.
