Syllabus

Course Objectives

The course aims to ensure that students:
- understand what law is and what are the peculiarities of legal phenomena;
- learn the fundamental concepts of the subject, the main theories and the state of the art of contemporary philosophical-juridical discussion;
- rework, through individual study and with the help of texts, the topics of the lessons;
- develop adequate skills in identifying and analyzing philosophical-juridical issues, also starting from positive law;
- acquire an adequate language in the presentation of problems and in their discussion.

Assessment Methods

The exam will be oral, with an ongoing written test with a non-binding outcome. The evaluation will be expressed out of thirty. To obtain the sufficiency (18/30) it is necessary to demonstrate sufficient knowledge on both exam texts.

Contents

The course aims to introduce students to the juridical phenomenon, distinguishing and examining in detail three major philosophical-juridical issues and their intertwining.
The first concerns the determination of what the law is. Students will be introduced to the main concepts of law and their theoretical foundations, deepening its major conceptual junctions.
The second concerns the identification of what is law. The issues of legal interpretation and the various issues that come into play when it comes to establishing the content of the rules will be examined.
The third part is about what the law should be. The topic of the moral evaluation of law will be studied in depth and the criteria by which this evaluation can be carried out will be discussed, within the framework of the broader relationship between law and justice.
