This contribution offers some first considerations on the proposed recast of Regulation 2201/2003 (so-called Brussels IIa), focusing on its most innovative aspects. In view of the European Commission's aim to amend the provisions in order to provide more efficient protection for those involved in cases concerning separation or divorce or the exercise of parental responsibility, questions arise as to whether these amendments adequately safeguard the best interests of the child.
