Forma dell’atto di riassunzione di un precedente giudizio e sinteticità degli atti nel processo amministrativo (Nota a Cons. giust. amm. Regione Sicilia, 3 marzo 2022, n. 20)

In the case, the appellant presents to the President of the CGARS an application for derogation from the dimensional limits of the acts provided for the appeal judgment, motivating the aforementioned application with the need to attack the sentence of the judge of first instance, re-proposing the reasons for the appeal at first instance, representing, in fact, the act of resumption of the judgment previously promoted to the civil judge.
An examination is therefore carried out regarding the principle of conciseness of the acts in the administrative process and the dimensional limits of the procedural acts of the party in the light of the regulatory provisions in force (especially the art.13-ter All. II c.p.a. and the d.P.C.S. 167/2016 ) as well as the most recent jurisprudence.
