Criminalità organizzata, ambiente e giustizia riparativa: alla ricerca di una difficile conciliabilità

The paper analyzes the difficult compatibility of restorative justice with respect to crimes resulting from organized crime. If the Cartabia Reform (Legislative Decree 150/2022) allows access to programs for any type of crime, perpetrator, victim, punishment, compatibility problems must be stressed with regard to the contexts of organized crime of mafia origin. This is due to the power dynamics that mafia crime activates and on which it is based; these require to consider the request for equality and freedom in access to restorative justice programs.
