Il sovraffollamento carcerario tra narrazione dottrinale, giurisprudenza contra legem e disattenzione del legislatore: alcune considerazioni dal punto di vista costituzionale

The paper addresses the topic of prison overcrowding: in particular, it highlights the influence produced on the jurisprudence of the narrative in the media debate and in the scholars.
As the paper will show, a difficulty emerges from Italian jurisprudence in "translating" the European rules of judgment to establish when a system is overcrowded and therefore when the prisoner's right to be compensated for the violation of the minimum space arises.
