Diritto cinese, comparazione giuridica e analisi tipologica degli ordinamenti costituzionali (riflessioni a partire dal volume sui sistemi del lontano Oriente del Trattato DPC)

The essay, after some methodological premises relating to the comparison of public law applied to the systems of the Far East and, in particular, to Chinese law, examines two aspects not much studied in the legal literature. First, attention to foreign law is analyzed in pre-socialist China, i.e. in imperial and nationalist China. Second, the characteristics of the socialist rule of law are considered, from the point of view of the juridical thought of the People’s Republic of China. The essay ends with an attempt to systematically frame the current Chinese political regime, in the light of both the millennial historical evolution of China and of its present socialist framework of public law.
