The course aims to provide students with a knowledge of the European integration process, the institutional system, the substantive law and the main policies of the European Union. At the end of the course, students will be able to better understand the functioning of the European Union through the examination of legal materials and the case law of the Court of Justice.
Students are invited to verify the information related to their studies programme.
The teaching will comprise both lectures focused on the study of the basic notions and legal sources regarding European Union law and practical lectures during which the relevant European case law will be analysed, as well as allowing students to intervene and participate actively. During the course, further materials will be used in order to support the study of the reference text and will therefore be provided to the students.
The final exam will be oral and will be held with a view to ascertaining, besides the knowledge of the topics of the course, that the student has developed sufficient analytical abilities. In particular, the oral examination is aimed at assessing the level of the preparation and the analytical and argumentative skills of the student.
The course focuses on the study of European Union law and consists of an institutional part and a part dedicated to fundamental policies.
The first part will cover the following topics: the European integration process and the founding Treaties, from the Treaty of Rome to the Treaty of Lisbon; the European Institutions; the sources and legal acts of the Union; the decision-making process and legislative procedures; the objectives and competences of the Union; the relationship between EU law and national legal systems (primacy of EU law, direct effect of certain EU rules and consistent interpretation); the protection of rights and actions before the Court of Justice; the citizenship of the Union.
In the second part, the topics covered will be: the area of freedom, security and justice and judicial cooperation; external relations, the common foreign and security policy and the common security and defence policy; the internal market; the fundamental freedoms (free movement of goods, free movement of workers, right of establishment and freedom to provide services, free movement of capitals); competition policy; economic and monetary policy.
