Syllabus

Course Objectives

The course aims to provide students with a basic knowledge of constitutional and general principles regarding the right to health as well as in relation to health care organization. At the end of the course, students will be able to better understand the national health care system and to address the main issues in health law with critical analysis skills.

 


Course Prerequisites

Students are invited to verify the information related to their studies programme.


Teaching Methods

The teaching will comprise both lectures devoted to learning the concepts, institutes, principles and rules of health law, and practical lessons (with analysis of specific cases and case law) during which students will be stimulated in the development of disciplinary and interpersonal skills, independent judgment, communication skills, and learning ability. Reflective analysis, case studies, problem posing/solving situations will be used for this purpose.

 Scholars or experts on specific topics are expected to speak during the lectures.



Assessment Methods

The final exam will be oral and will be held with a view to ascertaining, besides the knowledge of the topics of the course, that the student has developed sufficient analytical abilities. In particular, the oral examination is aimed at assessing: - the level of the preparation of the student;

- the analytical and argumentative skills of the student.

For attended students, an intermediate written test (open-ended questions) may be provided.



Contents

The teaching is divided into the analysis of the following topics:

1. Historical introduction and constitutional profiles of social rights, right to health and social welfare;

2. General principles on the right to health and welfare;

3. The division of legislative and administrative competencies in health care and the forms of connection between state and local authorities;

4. Health planning, the planning of social services and the Essential Levels of Care;

5.The birth of the Italian Health System also in a comparative perspective; the organization of the National Health Service and Regional Health Services;

6. The institutional actors of the health service at the international, European and national levels (the Ministry of Health, the “Consiglio superiore di sanità”, the “Istituto superiore di Sanità”, the “Agenzia Italiana del Farmaco”, the “Agenzia per i servizi sanitari regionali”, etc.) and at the regional level (the local health agencies, hospital agencies, etc.);

7. The staff of the National Health Service, with particular reference to health care management;

8.  Private participation in the provision of health services and their financing

A focus will be placed on digital health and the use of new technologies.

Students, both attending and non-attending, must rely on the program of the academic year in which they intend to take the exam (regardless of the academic year of enrollment or course attendance).

It is also recommended to view the bulletin board for additional information about the course and the moodle platform. Consultation of this platform is essential as it allows one to be informed of any changes in the discipline (the law, in fact, is subject to constant change). In case regulatory and jurisprudential developments make it necessary, any supplementary readings designed to update the contents of the Handbook will be indicated to students during the course (and appropriately marked on the platform).

Should the course be taught in a dual or remote learning mode, changes may be made to the syllabus with a view to granting the conduct of the course and examinations.
