Syllabus

Course Objectives

The students will acquire a complete basis of Italian public law, which is the law of the Italian Republic, a sovereign State, EU member State and part of the international community
More specifically, the course aims to:
a) provide knowledge of the basic tools of constitutional methodology;
b) develop knowledge of relationship between the powers of the State and of the Italian public decision-making;
c) stimulate deeper understanding and critical ability.

Assessment Methods

The examination is structured in two phases: a written test followed by an oral test. The first phase consists of a written examination, which may include multiple-choice questions and/or open-ended questions. Only candidates who successfully pass the written test will be admitted to the oral examination. The oral exam may be waived at the instructor’s discretion, based on the assessment of the written test.

Contents

1) the Law (rules and their interpretation), subjects (individuals and corporations, subjective legal situations), acts; 2) the State and its legal system (the conception of the State and the forms it has historically taken, the functions of the State, the Constitution, the political representation, the system of government, the European Union); 3) the organization of the Italian State: historical aspects, the Parliament, the Government and administration, the President of the Republic; 4) the judiciary power (the constitutional principles about jurisdiction, the ordinary and administrative justice); 5) the Constitutional Court (its structure, role and functions, the judicial review of legislation, the conflicts of powers, type and impact of constitutional rulings); 6) Regions and local authorities; 7) the sources of law (constitutional, international, EU, legislative, regulatory, regional and local sources); 8) the individual and collective freedoms and constitutional duties.
