Syllabus

Course Objectives

The course of International Law aims at providing knowledge of public international law, related to the concept of sovereignty of States in their mutual relations and also in the context of international organisations, the hierarchy of legal sources of international law and their effectiveness in the national legal system.
Furthermore, the course intends to provide knowledge of private and procedural international law, in relation to cases involving cross-border elements.

Teaching Methods

The teaching will comprise lectures devoted to the study of the key notions and legal sources of public and private international law, as well as practical seminars during which the relevant case law will be analysed and an active participation from the students will be encouraged. The reference textbook will be supported by further materials and readings that will be made available to the students.

During the year, exercises will also be organized, open to all students of the course, aimed at verifying the understanding of the subject and the suitability of the study method also for passing the final exam.


Assessment Methods

Students will be required to take an oral exam aimed at assessing the knowledge of the topics of the course as well as sufficient analytical abilities. More precisely, the exam will consist of an oral discussion with a view to verifying
- the level of preparation of the student;
- the analytical and argumentative skills of the student.

Contents

The course of International Law aims at addressing topics related to the study of both public and private international law.
With regard to public international law, the focus will be on the notion of international law, the State subjectivity in international law, the process of formation of international law rules and their content, the implementation of international law rules in the national legal system, the regime of international responsibility and the international dispute settlement mechanisms.
As to private international law, the course will focus on the concepts of private international law according to both a narrow and a wide meaning, the structure and features of private international law rules, the limits on the functioning of these rules, paying particular attention to the legal instruments adopted by the European Union in this area.
