Syllabus

Course Objectives

- Knowledge and understanding. Students must demonstrate that they have acquired a basic knowledge of comparative and international labour law and of the main regulations covered in the course.

- Application skills. Students must demonstrate that they can apply the concepts learned to concrete contexts and specific cases.

- Independent judgement. Students must demonstrate that they can take reasoned and legally sustainable positions with reference to the topics covered in the course.

- Communication skills. Students must demonstrate that they are able to express the concepts acquired with coherent reasoning, systematic rigour and appropriate language.

- Learning skills. Students must demonstrate that they are able to reconstruct the historical and evolutionary profiles of the subject and related economic phenomena, applying the relevant regulatory framework where necessary.

Teaching Methods

The first part of the course will consist of lectures aimed at clarifying the legal framework of labour law in relation to the phenomena and practices covered by the course, including through educational seminars with the participation of foreign professors for the purpose of comparison with other legal systems. The teaching also includes in-depth study of certain topics through research and the use of international databases. This in-depth study may result in a research paper to be presented in class and/or discussed during the exam. The second part of the course will consist of lectures aimed at

exploring the regulatory framework and legal issues of the institutions covered in the specific part of the course. Teaching will involve constant dialogue with students, also through their voluntary application to examine specific cases to be discussed in class.


Assessment Methods

The exam is oral and the assessment is expressed as a mark out of 30, with honours. The criteria for assessing the oral exam take into account the accuracy of the content, clarity of argumentation, and critical analysis and reworking skills. Attending students will be able to take intermediate tests in accordance with the procedures indicated in class and published on the course website. These tests relate to the topics covered in class and take the form of oral tests. In order to pass the exam, students must be able to demonstrate in-depth knowledge of comparative labour law and other regulations covered in class. Based on this knowledge, students are required to form reasoned opinions on the evolution of phenomena related to business and labour mobility, including through the analysis of specific cases discussed in class.


Contents

The course is dedicated to exploring the effects of globalisation on legal systems, focusing on issues and perspectives of labour law in its global dimension. Particular attention is paid to the regulatory action carried out by the International Labour Organisation in promoting the protection of fundamental social rights. To this end, the following topics will be covered in depth: the role of the International Labour Organisation over the last hundred years: structure and functioning; the ILO and the effectiveness of protection; the relationship between ILO conventions and European law; the evolution of international labour law: focus on fundamental labour standards; migration and international law; ratification and application of international labour standards; decent work and international trade; ILO Centenary Declaration and Agenda 2030. After this general background, the second part of the course will deal with social clauses in international trade agreements and trade union law in the international dimension.
