Syllabus

Course Objectives

This course enables students to deepen their understanding of Contract Law. The Comparative Law approach and content will enable students to identify similarities and differences, particularly in terminology, between different civil law and common law systems. By the end of the course, students will also be able to recognize the key features of European Contract Law, with a particular focus on Consumer Law, especially in the context of the Digital Single Market. Through the analysis of supranational sources and both national and European case law, students will acquire and further develop autonomy and critical thinking in legal scholarship and reasoning.


Course Prerequisites

Elements of Contract Law.


Teaching Methods

Lectures.


Assessment Methods

Oral exam.

The evaluation is based on a 30-point scale.

A midterm assessment is planned for students who attend the course.


Contents

The course is divided into two parts.

The first part focuses on the general rules governing Contract Law in the main civil law and common law systems. The content encompasses freedom of contract; contract formation and contents; vitiating factors; performance and non-performance; and remedies.

The second part covers Consumer Law within the European Union, including its scope of application; consumer rights; unfair commercial practices; unfair terms; remedies; supply of digital content and services; product safety, quality, and conformity; and contracts in the platform economy.

The subject matter will be explored through both theoretical study and the examination of pertinent case law.
