Syllabus

Course Objectives

The course aims to ensure that students:
- understand what law is and what are the peculiarities of legal phenomena;
- learn the fundamental concepts of the subject, the main theories and the state of the art of contemporary philosophical-juridical discussion;
- rework, through individual study and with the help of texts, the topics of the lessons;
- develop adequate skills in identifying and analyzing philosophical-juridical issues, also starting from positive law;
- acquire an adequate language in the presentation of problems and in their discussion.

Assessment Methods

The exam will be oral, with an ongoing written test with a non-binding outcome. The evaluation will be expressed out of thirty. To obtain the sufficiency (18/30) it is necessary to demonstrate sufficient knowledge on both exam texts.

Contents

The course aims to introduce students to the phenomenon of law, distinguishing and examining
in detail two major philosophical-legal questions and their interconnections.
The first concerns the definition of law. Students will be
introduced to the main conceptions of law and the concepts that structure it.
The second concerns the definition of law. The various
issues that come into play when it comes to establishing the content of norms will be examined, also
in light of the constitutionalization of legal systems.

Provisions and Norms

Variety of Norms
Rules and Principles
Subjective Situations and Rights

Law and Constitution
The Separation of Powers
