In the context of the most modern doctrine, the systematic-axiological method allows the interpreter to overcome the literal data and, in a hermeneutic perspective of reconstruction of individual acts and behaviors, to reach the most adequate solution, conforming the administrative action to the criteria of solidarity, sustainability, reasonableness, proportionality and conservation. The relationship between the negotiation activity and the fallout from the action is the trait that more than any other characterizes and distinguishes negotiations between private individuals from those in which a public entity is involved; and this is the hermeneutic perspective that the interpreter must take as a focal point to evaluate and identify the ordering of the concrete case with regard to the general interest.
