Uno sguardo di genere sulla sentenza 33 del 1960

The article analyses the “historical” judgment n. 33/1960 given by the Italian Constitutional Court in the constitutional perspective of gender sensitive equality, which means considering not only parity between men and women and anti-discrimination, but also antisubordination and equal social dignity. This approach aims at integrating the sexual difference in the horizon of social relations and in the construction of legal categories. The comparison of judgement 33 with previous and subsequent constitutional jurisprudence (in particular the rulings n. 56/1958 and 172/2001) shows the undoubted merits of this judgement as a turning point, a real milestone, but also reveals its weaknesses, that still mark and affect the full understanding and implementation of the fundamental constitutional principle against gender subordination.
