Abstract:
With the Restoration, in many pre-unitarian states a broad discussion on the reform of the inquisitorial process starts developing. The aim is that of introducing more public debate and contradictory. In Tuscany, the issue arises in the committee appointed by the Grand Duke for drafting the new code of criminal procedure. Two opposing groups are there present: the first, the reformist one, willing to return to the French mixed model. The other, expression of the old Tuscan criminal school, trying to defend the written and secret instruction compiled by a notary. Already in 1825 the Commission resolves in favor of debate with conflicting views in open court. Still a reform will be implemented only in 1838.
