La modalidad de los enunciados normativos: una comparación entre gramática y teoría del derecho

This paper focuses on the ways prescriptive utterances were analysed in grammar and in the theory of law. Starting from the concept of norm, the classification of such utterances is described in traditional grammar, from their taxonomy based on mood and on the modus/dictum distinction to the emergence of the fresh notional category of modality in modern linguistics. Moreover, the interrelationship between grammar and philosophy of law is discussed as concerns the configuration of the deontic domain and the importance of the modal anankastic category – nowadays accepted by Italian grammarians but still ignored in modern Spanish grammar books – is stressed as a tool for analysis of normative discourse.
