abstract:
The defense of the right to education for disabled persons is one of the major focus of national and international institutions from several decades, since the adoption of the Declaration on the Rights of Disabled Persons by the UN General Assembly on 9 December 1975. In the last few years the regulatory evolution of inclusive education of students with disabilities has suffered essential interventions by the policy-maker and the Minister of Education in our country as well as in many European Member States. The most important rules remain Law No. 104/1992 on disability, Law No. 170/2010 and subsequent modifications for students with Specific Learning Disability (SLD) and Law No. 53/2003 on the issue of personalization. In addition to many legislative measures, the constitutional and administrative laws have intervened several times in order to better define the single scope of the rules at issue.
