Syllabus

Course Objectives

The Labour Law II course deals with the regulatory framework of labour law in the international and European context. The objectives of the course are to provide students with basic knowledge of international and European labour law and to stimulate the acquisition of an awareness of the legal obligations arising from transnational labour relations. The reflections will focus on the condition in which companies find themselves operating in a globalised world in which the relocation of production processes has undoubted effects on labour relations. At the end of the course the student has acquired knowledge of European and international institutions, their tasks and actions, and has acquired in-depth knowledge of social and labour issues. With regard to international labour law, at the end of the course the student has acquired knowledge of international labour standards and the subjects covered by them; he/she has acquired their application and promotion as well as knowledge of the bodies responsible for their elaboration and the instruments necessary for their implementation. At the end of the course, the student possesses a thorough knowledge of international labour standards and is able to analyse legal institutes in the field of labour law with propriety of language and to consult EU and international regulatory sources for the resolution of complex situations. This knowledge is the basis for developing the analytical, research and critical skills required to deal with the various dimensions of labour law. The teaching aims to familiarise students with the functioning of the system of multilevel sources, international and supranational soft law sources, also focusing on the main organisations representing the interests of companies on a supranational scale and their logic of action. With regard to the teaching of EU labour law, the course will address the interventions of the European Union in social and labour matters with particular reference to the free movement of workers also with regard to European immigration policy. During the course, supplementary teaching activities will be organised in the form of tutorials in small groups, exercises, e.learning activities, PSCs, in-depth seminars, additional interactive activities. Qualified experts in the field will participate in these in-depth activities and working groups will be organised during these meetings on topics addressed in the course. All these activities are intended to encourage the involvement of the student, who is asked to intervene in the identification of regulatory instruments applicable to particular situations, through case studies or the participation of experts. The aim of the course is to encourage concrete and active interaction in order to refine and acquire the skills necessary to tackle the problems inherent in the subject, to know how to confront and support legal arguments, to know how to interpret and prepare legal documents, all indispensable skills for the professional figure of the jurist and labour consultant where one has opted for this pathway.

Teaching Methods

Teaching will be developed through the delivery of lectures, supported by explanatory power point presentations. The course includes periodic exercises and activities to assess learning, teaching seminars aimed at deepening particular topics with the involvement of both students and experts in the field. As part of the course, educational trips to the Court and/or to the Tax Commission will be organised with the assistance of the lecturer in order to deal with particular topics (for approximately 6 hours); seminar meetings in preparation for the hearings themselves will also be planned and organised (for approximately 4 hours). The lecturer reserves the right to organise some lessons in co-teaching with foreign professors (Spanish or French speaking) to allow a comparison of the system as well as the acquisition of language skills. In parallel with the course for those who have opted for the Employment Consultant pathway, didactic seminars will be offered in preparation for the courses and for taking the Employment Consultant exam. The lectures, although mainly theoretical in nature, include the analysis of concrete examples, so as to enable the student to deepen also the applicative profile of the issues dealt with. The teaching envisages the in-depth study of certain topics through research and the use of international databases. These in-depth studies must result in a report that will be discussed during the examination. These insights must be translated into an in-depth work in the form of a report that will be presented in class and discussed in the examination. It should be noted that part of the lessons will be done with foreign co-teachers


Assessment Methods

In general, the verification of the learning of knowledge and the attainment of results takes place by means of an oral test and the assessment will be expressed in thirtieths. The questioning will be structured in two to three questions on the entire syllabus in order to verify the students' acquisition of the fundamental knowledge of the subject matter; the ability to systematically frame the subject matter, the property of language and the demonstration of being able to connect and critically analyse different topics.

During the course, the lecturer will involve the attending students in group work and research. The results of this work will be reported in the classroom and will contribute to the final assessment. The lecturer also reserves the right to organise in-progress verification of knowledge in order to help students acquire autonomy of analysis, judgement and communication skills. The results of these papers will contribute to the assessment of the knowledge acquired during the course and will be considered as part of the students' ongoing assessment.

Intermediate papers will cover part of the course programme and their outcome will only be considered if positive.
The oral examination for those who have done group work will cover the part of the syllabus not affected by the work done and the average of the two marks obtained (only if both positive) will contribute to the formation of the final grade.

Contents

The Labour Law II course deals with labour law in its supranational perspective. In the first part, the course provides an overview of the principles underlying the rules contained in the ILO conventions and recommendations, starting from the analysis of the principles of the modern and contemporary international order to analyze the progressive institutionalization of international relations. In the rest it deals with the international organization of work, focusing on the role played and functions exercised by international bodies.
The course in particular promotes knowledge of the skills of the main protagonists of the transnational dimension of employment relations; knowledge of international and supranational institutions and their actions; knowledge of international jurisprudence.
The second part of the course will deal with the normative and procedural aspects of European social policy. The main European directives and judgments on the subject will be analysed
