Syllabus

Course Objectives

The Course will teach students the correct approach to Private Law and provide the knowledge of its principles, concepts, institutions, essential for every legal career. Valuing which are the interests the legal system is protecting each time is mainly important for those who attend every legal career. Through practical case-law studies the course is also intended to provide a method for this. At the end of the course, students will be able to identify the “ratio” (the “reason”) of legal rules, suitably connecting the different legal instruments. They will achieve a proper and correct language and be able to reason about the importance of rules, principles and inner workings of the private law system.


Course Prerequisites

An adequate knowledge of italian language is required.

Teaching Methods

Lectures, seminars, practical exercises on legal cases. In all activities, dialogue and interaction with partecipants will be encouraged.


Assessment Methods

The examination is oral. The evaluation of the oral exam is expressed in 30ths. During the exam the professor tests knowledge of the student about legal institutes, his/her technical language, his/her ability to identify the aim of the rule looked on, the interpretive profiles. Preciseness, entirety of the answer, correct language and links among the different institutes are the main requirements the professor takes into account for the evaluation and the score in 30ths of the test. Clauses. - Effectiveness of the agreement. - Validity and invalidity of the agreement. - Termination of the contract. - Individual contracts. Notions, notes, hints (in particoluar: contracts of sale; - contracts of use; - mandate and agency agreement; - contracts for provision of work or services; - contracts for settlement of disputes). - Sources of non-contractual obligation ("acts and facts" different from the contract). - The tort. - Facts and abuse liability. - The system of inheritance. - Donations inter vivos. - The family group.

1. Course reading list is available on Leganto App. 2.Teacher communications will take place using the personal web page and the e-learning area. 3. The program is valid for both attending and non-attending students. 4.Erasmus students, students they need some credits integration and students with PDP or IEP are invited to contact the teacher at the beginning of the course. 5. The teacher will organize more activities and practical exercises on legal cases to help the students in the improvement of their legal knowledge. These activities will be published in the web page of the Teacher and in the e-learning area. 6. 6. After closing the registrations for each exam session, registered students will be informed by e mail about any specific rules for the operations (order followed, possible shifts, etc.).
