Teaching Methods
Teaching is delivered through traditional lectures.
Students also have the opportunity to participate in the Negotiation Lab, an English-language programme led by Prof. Francesca Locatelli, where they study negotiation principles based on the Harvard Law School approach.
Students attending the Negotiation Lab are eligible to take part in the Italian Negotiation Competition and, if selected, the International Negotiation Competition (INC), the world's first and largest English-language negotiation competition for law students. They may also compete in The Negotiation Challenge, another prestigious international negotiation competition.
The aim of the Negotiation Lab is to foster students' interest in negotiation while equipping them with the knowledge, practical skills, and strategic mindset required to manage complex transactions and international disputes. Throughout these competitions, participants learn to navigate cultural differences, adapt to diverse negotiation styles, and address ethical considerations, social norms, and business practices across different jurisdictions.
The Negotiation Lab consists of 36 hours of instruction. Each year, students who successfully complete the programme are awarded extra-curricular academic credits.
Although optional, the Negotiation Lab is strongly recommended as a complement to the courses in Civil Procedure and Institutions of Civil Procedure. It represents a valuable opportunity not only from an academic perspective but also in terms of the University of Bergamo's internationalisation strategy and students' employability. In previous editions, several participants received internship offers and even full-time employment opportunities from leading international organisations and law firms. The competition therefore provides an outstanding platform for professional visibility and career development.
Assessment Methods
The acquisition of concepts and specific lexicon will be the subject of evaluation.
Contents
The course relates to the following topics: the plaintiff and the action; the defendant; the detection of the object of the trial; the duty of the Court to decide and its limits; the Court; jurisdiction and competence; the party: capacity, legitimacy and representation in case proceedings; the defense counsel; trial with multiple parties; the prosecutor; the formal discipline of the acts of the process in general; invalidity of pleadings. The syllabus is the same for attending and non-attending students and it consists in the study of the mentioned book. A seminar session will be held alongside the official course to provide support and enrichment.
