Curriculum Vitae

Marco Azzalini, after his high school leaving qualification specializing in classical studies, enrolled in the Law Faculty at the University of Padua, from which he graduated with honours discussing a thesis in civil law: “La presupposizione in Italia e in Germania dopo la sua codificazione nel BGB”, developed under the guidance of Prof. Giorgio Cian. The thesis was the winner of the “Casati” National culture prize, published by the Accademia Nazionale dei Lincei in co-operation with O.N.A.O.S.I.
Straight after his degree he competed for a place at the Doctoral School in Private Law, International Law and Labour Law promoted by the University of Padua, and was classified first place for the field of study “Private Law in the European Dimension”.
In the three years of his doctorate he continued to concentrate on the themes of the obligation bond in general, analysed according to a broad comparative prospective as well, paying particular attention to the legal experiences of the German-speaking world. On 3/4/09, he gained the title of Doctor of Research and was assessed excellent, presenting a thesis entitled “Genus numquam perit? Responsabilità e debito nell’obbligazione generica”, this was also developed under the supervision of Prof. Giorgio Cian.
From January 2009 to December 2010 he was awarded a research grant from the Department of Private Law at the University of Padua, devoting himself to a research project on the subject of the interpretation of the general conditions of a contract, under the guidance of Prof. Stefano Delle Monache.
In the first part of 2011 he was awarded a research grant at the Department of Comparative Law at the University of Padua, devoting himself to a research project on the subject of discrimination in business relations in Italian and European law, under the supervision of Prof. Ettore Scimemi.
In the second part of 2011 he was awarded a research grant senior at the Department of Comparative Law at the University of Padua, devoting himself to a research project on the protection of the personal identity, under the supervision of Prof. Renato Pescara.
In the years following graduation he has undertaken an intense didactic activity, collaborating with the Chair of Civil Law, held by Prof. Giorgio Cian first and then Prof. Aldo Checchini. He has also worked with Prof. Paolo Zatti, Prof. Giuseppe Amadio, Prof. Stefano Delle Monache, Prof. Renato Pescara, Prof. Ettore Scimemi, Prof. Manuela Mantovani, Prof. Roberto Pucella.
He has been, again in the years following graduation, a member of the examination commission at the Chair of Civil Law and Private Law at the University of Padua. He has also collaborated on the courses of the Galileian School of Further Studies at the University of Padua, in particular on those held by Prof. Giorgio Cian in the years 2007 - 2010. In 2008 he qualified to practise the legal profession and consequently he joined the Bar of Padua, the Ordine degli Avvocati di Padova, at the beginning of 2009. Since 2008 he has also carried out training activities for trainee lawyers for the Treviso Bar Foundation, since then he has annually held a course of exercises there to prepare trainees for the qualifying examination for the legal profession. As part of this he has edited eight volumes entitled “Casi e pareri di diritto civile”, published respectively in 2008, 2009, 2010, 2011, 2012,2013, 2014, 2015.
Since 2009 he has carried out training activities for lawyers in collaboration with the Provincial Law Association of Bergamo, at the premises of which he has held conferences and seminars on themes of classic civil law. He’s also professor in the lawyer school of Bergamo. He also participated, as speaker, at the doctoral school “Corso di Dottorato di Ricerca in Diritto internazione e diritto private e del lavoro” in the University of Padua, and also partecipated, as speaker, in more specialistic courses (f.e. Corso di Alta formazione in Diritto di Famiglia e Minorile), and other doctoral schools and master’s degree courses.

He’s Associate Professor in private law from 2017 in the University of Bergamo; form 2012 he was permanent employed as researcher in the University of Bergamo, Dipartimento di Giurisprudenza; since the academic year 2008/2009 untill the a. y. 2014, he has been assigned tenure of the course of Institutions of Private Law on the three-year degree course for Company Legal Practitioner offered by the University of Bergamo, also with the supervision of a lot of students for the graudation dissertation. Form the a.y. 2015/2016 he’s the holder of the course of Institutions of Private Law in the Law degree course of University of Bergamo. From the academic year 2012/2013 he’s assigned the tenure of the course of Institutions of Private Law on the course for Bachelor's degree in Economics and Business offered by the University of Bergamo, also with the supervision of a lot of students for the graduation dissertation. Form the a.y. 2017/2018 he’s the holder of the course of Information Law in the publishing and communication degree course of University of Bergamo. Form the a.y. 2023/2024 he’s the holder of the course of Intellectual property law in Text sciences and culture enhancement in the digital age degree course of University of Bergamo.
Prof. Azzalini has also collaborated with the journals Nuova giurisprudenza civile commentata, Biolaw Journal, Rivista di diritto civile, Studium iuris, Responsabilità civile e previdenza, Diritti, Responsabilità medica and others. He is the author of numerous papers, articles and notes about rulings.
He has also collaborated on the Commentario giurisprudenziale sistematico al codice civile e alle leggi complementari 2009 edited by Giorgio Cian (Cedam), and also on the second edition in 2016, and on the the 2009 edition of “Istituzioni di diritto civile” by A.Trabucchi (Cedam).
After gaining the title of Doctor of Research, his scientific interests have continued to turn to the study of the law of obligations, the results of which have been condensed into two extensive monographic works entitled “L’impossibilità e l’inesigibilità nell’obbligazione generica” and “Obbligazioni di mezzi e di risultato – Categorie giuridiche travisate”. Parallel to this, he has also turned his attention to more topical themes concerning the rights of an individual, the right of identity and integrity and the relationship between doctors and patients. This scientific interest is documented in his contributions “Le disposizioni del paziente: prospettiva civilistica”, publicated in the Treaty of Biorights edited by Stefano Rodotà and Paolo Zatti and “I malati” publicated in “I nuovi Danni alla persona. I soggetti deboli” edited by Paolo Cendon, and in a lot of extended papers and essays (f.e. regarding refusal of care by both mentally capable and incapable patients, which appeared in the journal La Nuova Giurisprudenza civile commentate). He also turned his interest in tort law and civil liability, with extended papers and essays, and in succession law.
From 2018 he’s member, as vice President and later (from 2024) as President, of the ethics committee of Azienda Ospedaliera Università di Padova.
He’s member of the scientific committee of the journals Professionalità and Professionalità studi (Studium Edizioni) and member of the editorial committee of the journal Responsabilità medica. Diritto e pratica clinica (Pacini Edizioni); he’s also member of the referee committee of the journal Archivio Giuridico Sassarese and of the journal BioLaw Journal-Rivista di Biodiritto.
For the years 2017/2018 he’s member of the examining board for the bar exam (Corte d’Appello di Brescia). In 2018, he’s member of the examining board for the doctoral exam at the doctoral school “Corso di Dottorato di Ricerca in Diritto internazione e diritto private e del lavoro” in the University of Padua. From 2013 he’s member of the joint commission (professors- students) in the University of Bergamo, Dipartimento di Giurisprudenza. From 2015 to 2023 he’s member of the Teaching and Learning Quality Commission of the University of Bergamo.
From 2023 he’s member of the PhD Program Board of the doctorate in Law in the University of Bergamo. Prof. Azzalini has been a member of numerous research groups (PRIN Groups, research groups in University of Bergamo and more) and he’s the head of the research group in some of them.
